Leaf Viza is committed to maintaining the accuracy, confidentiality, and security of your personally identifiable information ("Personal Information"). These Terms of Service ("Terms") govern your access to and use of the Leaf Viza website, client portal, and related services (collectively, the "Services"). Our practices are aligned with the Canadian Standards Association's Model Code for the Protection of Personal Information and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). By using the Services, you agree to be bound by these Terms.
1. Introduction
We are responsible for maintaining and protecting the Personal Information under our control. We have designated individuals who are responsible for compliance with our privacy and security obligations. If you do not agree with these Terms, you must not access or use the Services.
2. Identifying Purposes
We collect, use, and disclose Personal Information to provide you with the products or services you have requested and to offer you additional products and services we believe you might be interested in. The purposes for which we collect Personal Information will be identified before or at the time we collect the information. In certain circumstances, the purposes may be clear, and consent may be implied — for example, when your name, address, and payment information is provided as part of an order.
3. Consent
Knowledge and consent are required for the collection, use, or disclosure of Personal Information except where required or permitted by law. Providing us with your Personal Information is always your choice. However, your decision not to provide certain information may limit our ability to provide you with our products or services. We will not require you to consent to the collection, use, or disclosure of information as a condition to the supply of a product or service, except as required to be able to supply the product or service.
4. Limiting Collection
The Personal Information collected will be limited to those details necessary for the purposes identified by us. With your consent, we may collect Personal Information from you in person, over the telephone, or by corresponding with you via mail, fax, or the Internet.
5. Limiting Use, Disclosure and Retention
Personal Information may only be used or disclosed for the purpose for which it was collected unless you have otherwise consented, or when it is required or permitted by law. Personal Information will only be retained for the period of time required to fulfill the purpose for which we collected it or as may be required by law.
6. Accuracy
Personal Information will be maintained in as accurate, complete, and up-to-date a form as is necessary to fulfill the purposes for which it is to be used.
7. Safeguarding Customer Information
Personal Information will be protected by security safeguards appropriate to the sensitivity level of the information. We take all reasonable precautions to protect your Personal Information from any loss or unauthorized use, access, or disclosure, including encryption in transit and at rest, role-based access controls, and continuous monitoring.
8. Openness
We will make information available to you about our policies and practices with respect to the management of your Personal Information. You can review our Privacy Policy for more detail.
9. Customer Access
Upon request, you will be informed of the existence, use, and disclosure of your Personal Information, and will be given access to it. You may verify the accuracy and completeness of your Personal Information, and may request that it be amended, if appropriate. However, in certain circumstances permitted by law, we may not disclose certain information to you — for example, if other individuals are referenced or if there are legal, security, or commercial proprietary restrictions.
10. Acceptable Use
You agree not to use the Services to: (a) violate any applicable law or regulation; (b) infringe the rights of any third party; (c) upload malicious code or attempt to disrupt the Services; (d) attempt to gain unauthorized access to any account, system, or data; or (e) misuse client information stored in the platform. You are responsible for obtaining all necessary consents from your clients before uploading their information to the Services.
11. Accounts and Security
You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us immediately of any unauthorized use. We recommend enabling two-factor authentication where available.
12. Fees and Payments
Paid plans are billed in advance on a recurring basis according to the plan you select. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; continued use of the Services after the effective date constitutes acceptance of the new pricing.
13. Intellectual Property
The Services, including all software, content, trademarks, and design elements, are owned by Leaf Viza or its licensors and are protected by intellectual property laws. You retain ownership of the data and documents you upload, and grant us a limited licence to host, process, and display that data solely as required to operate the Services.
14. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. Leaf Viza does not provide legal advice, and nothing in the Services constitutes legal advice or creates a solicitor–client relationship.
15. Limitation of Liability
To the maximum extent permitted by law, Leaf Viza shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services.
16. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, your right to use the Services ceases immediately; certain provisions (including intellectual property, disclaimers, and limitation of liability) survive termination.
17. Cookies
A cookie is a small computer file or piece of information that may be stored on your device when you visit our websites. We may use cookies to improve our website's functionality and, in some cases, to provide visitors with a customized online experience. Most web browsers are configured initially to accept cookies automatically. You may change your browser settings to prevent your device from accepting cookies or to notify you when you receive a cookie. Disabling cookies may affect the performance of the Services.
18. Other Websites
The Services may contain links to third-party websites. We are not responsible for the content, policies, or practices of any third-party site. Your use of those sites is at your own risk and subject to their terms and policies.
19. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notification. Your continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.
20. Governing Law
These Terms are governed by the laws of Canada and the province in which Leaf Viza is established, without regard to conflict-of-law principles. Any disputes will be resolved in the competent courts of that jurisdiction.
